In this case, our client suffered a fracture of the calcaneus, or heel bone, during a car accident. As the American Academy of Orthopaedic Surgeons will attest, this type of fracture commonly occurs during high impact events such as a car crash or a fall from a ladder (i.e., when the heel is crushed under the weight of the body). When this occurs, the heel can become deformed potentially result in chronic complications such as pain, swelling, loss of motion, and arthritis.
The maximum offer we received in this case was $65,000. We presented very compelling testimony as to the facts that this very difficult fracture had on our client’s ability to function at work and at home, and how it would affect her for the rest of her life. The arbitration panel awarded $317,000.
